Acceptable Use Policy

Cheltenham Creatives is a project operated by Happy by Design Ltd (company registration 10373622).

This acceptable use policy covers the products, services, and technologies (collectively referred to as the “Products”) provided by Cheltenham Creatives under any ongoing agreement. It’s designed to protect us, our members and the general Internet community from unethical, irresponsible and illegal activity.

Cheltenham Creatives members found engaging in activities prohibited by this acceptable use policy can be liable for service suspension and account termination. In extreme cases, we may be legally obliged to report such members to the relevant authorities.

Fair Use

We provide our facilities with the assumption your use will be “business as usual”, as per our offer schedule. If your use is considered to be excessive, then additional fees may be charged or capacity may be restricted.

We are opposed to all forms of abuse, discrimination, rights infringement and/or any action that harms or disadvantages any group, individual or resource. We expect our members and, where applicable, their users (“end-users”) to likewise engage our Products with similar intent.

Member Accountability

We regard our members as being responsible for their own actions as well as for the actions of anyone using our Products with the member’s permission. This responsibility also applies to anyone using our Products on an unauthorised basis as a result of the member’s failure to put in place reasonable security measures.

By accepting Products from us, our members agree to ensure adherence to this policy on behalf of anyone using the Products as their end users. Complaints regarding the actions of members or their end-users will be forwarded to the nominated contact for the account in question.

If a member – or their end-user or anyone using our Products as a result of the member – violates our acceptable use policy, we reserve the right to terminate any Products associated with the offending account or the account itself or take any remedial or preventative action we deem appropriate without notice. To the extent permitted by law, no credit will be available for interruptions of service resulting from any violation of our acceptable use policy.

Listings and Content

When you submit an application or listing to Cheltenham Creatives, you agree that the information you provide is accurate and genuinely represents your business, skills, or services. You won’t misrepresent your qualifications, experience, or the nature of your work, and any images, descriptions, or content you submit must be your own or something you have the right to use.

Listings must relate to genuine creative services or businesses based in or serving the Cheltenham area. We don’t accept listings that are primarily for unrelated advertising, resale of goods, or services outside the creative and small business community the directory is designed for.

You won’t post anything that’s offensive, discriminatory, defamatory, or unlawful, or that infringes someone else’s intellectual property, copyright, or trademark.

You won’t impersonate another business, individual, or brand, or create a listing on behalf of someone else without their knowledge and consent.

Our Right to Remove or Decline

We reserve the right to decline, edit, suspend, or remove any listing or application at our sole discretion, including where we believe it breaches this policy or the wording doesn’t fit the tone or purpose of the directory. As set out in our Terms and Conditions, submitting an application does not guarantee acceptance.

Consequences

Where a listing or member breaches this policy, we may remove the listing immediately without notice. In serious or repeated cases, we may also decline any future applications from that individual or business.

Unauthorised Use of Cheltenham Creatives’ Property

You must not impersonate Cheltenham Creatives, claim a business relationship with us that doesn’t exist, or use our name, branding, or any other Cheltenham Creatives property to fraudulently gain trust, custom, or advantage.

About This Policy

This policy outlines a non-exclusive list of activities and intent we deem unacceptable and incompatible with our brand.

We reserve the right to modify this policy at any time by publishing the revised version on our website. The revised version will be effective from the earlier of:

• the date the member uses our Products after we publish the revised version on our website; or
• 30 days after we publish the revised version on our website.
